By accessing or using Kinn ("Service"), provided by WASD Corporation ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

1. Acceptance of terms

By accessing or using Kinn, you agree to be bound by these Terms. If you do not agree, you may not access or use the Service.

2. Description of service

Kinn is a web-based platform that provides feedback analytics and research tools to support game studios in building more effective video games.

3. Eligibility

You must be at least 18 years old and capable of entering into legally binding agreements to use the Service. By using the Service, you represent and warrant that you meet these requirements.

4. Account registration

To access the Service, you must create an account. You agree to provide accurate, current, and complete information and to keep your account credentials secure. You are responsible for all activity conducted under your account.

5. Subscription and billing

Access to Kinn is provided on a paid subscription basis, starting at $150 per month. You may cancel your subscription at any time; cancellation will take effect at the end of the current billing cycle. Refunds are issued at the sole discretion of WASD Corporation.

6. Ownership verification

You may only track and analyze video games that you or your organization own or are legally authorized to represent. We reserve the right to verify ownership before allowing data tracking. Any misrepresentation of ownership may result in immediate suspension or termination of access to the Service.

7. Acceptable use

You agree not to:

• Reverse engineer, decompile, disassemble, or attempt to extract the source code of any part of the Service
• Attempt unauthorized access to any system, network, or data related to Kinn
• Use the Service for any illegal or unauthorized purposes

We reserve the right to suspend or terminate access for any violation of these Terms.

8. Use of YouTube API Services

Kinn uses YouTube API Services to access and analyze publicly available video data, comments, metadata, and engagement information for the purpose of providing aggregated insights to game studios.

Important clarifications: Kinn does not require users to log in to YouTube or Google accounts; does not request, collect, or store YouTube account credentials, passwords, or private account information; only publicly accessible data is processed; and users may submit YouTube video or channel URLs to be analyzed.

By using Kinn, you also agree to be bound by the YouTube Terms of Service. If there is a conflict between these Terms and the YouTube Terms of Service, the YouTube Terms of Service shall take precedence with respect to any data obtained from YouTube API Services. Kinn is not affiliated with, endorsed by, or sponsored by YouTube or Google LLC.

9. Availability & support

We guarantee 90% uptime, excluding scheduled maintenance and force majeure events. Support is available 24 hours a day via email at support@kinn.gg.

10. Intellectual property

All content, software, data processing methods, designs, trademarks, and technology associated with the Service are the exclusive property of WASD Corporation or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or misuse the platform. Upon termination, your access to the Service will be revoked, and any stored customer data may be deleted in accordance with our Data Handling & Deletion Policy.

12. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, fully secure, or error-free.

13. Limitation of liability

To the maximum extent permitted by law, WASD Corporation shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to data loss or business interruption.

14. Governing law & jurisdiction

These Terms and any disputes arising out of the Service shall be governed by the laws of the State of Idaho, United States, without regard to its conflict of laws principles. All legal proceedings must be brought in state or federal courts located in Boise, Idaho.

15. Changes to these terms

We may update these Terms from time to time. If material changes are made, we will notify users via the platform or by email. Continued use of the Service constitutes acceptance of the revised Terms.
